Interpretation:
Penkat Studio: Penkat Studio is a trading name of Streetmap.EU Ltd., 80 Vernier Crescent, Medbourne, Milton Keynes, MK5 6FE.
Client: For the purpose of this agreement, the term Client is anybody buying, hiring and renting services from Penkat Studio.
Images: Photographs, digital negatives, prints, video, rushes, edits, post production and showreels produced by Penkat Studio.
Kit: Any item, space or product belonging to or rented by Penkat Studio.
Words in the singular include the plural and those in the plural include the singular, and references to masculine words include the feminine.

Delivery policy:
Photography sessions with Penkat Studio:
Clients pay for this service in the studio after the session. The product is taken home by the Client on the same day as the photography session.

If Client orders a product that is produced outside of the studio then the average timeframe for receiving the product is approximately two weeks. We do however treat each sale on an individual basis and the Client will be notified at the point of sale as to an estimated delivery time. We endeavour to keep to a tight schedule making a quick turn-around time. The method of delivery will be either by post, delivered personally, or by collection from the studio.

Online Photograph Sales:
The average timeframe for purchasing and receiving photographs bought via PhotoReflect is approximately two weeks. We do however treat each photograph sale on an individual basis and the Client will be notified at the point of sale as to an estimated delivery time. We endeavour to keep to a tight schedule making a quick turn-around time.

The method of delivery will be either by post, delivered personally, or by collection from the studio.

Video sessions and video production with Penkat Studio:
Clients pay for this service in the studio after the session. If the end product cannot be delivered to the Client at the end of the session then the Client and Penkat Studio discuss the delivery date and method.

Studio Hire (including video editing systems):
Clients wishing to hire the studio are permitted to pay a non-refundable deposit of twenty percent to secure the booking for this service. The balance is payable on the day.

Cancellation Policy:
Photography sessions with Penkat Studio:
Clients are permitted to cancel a booking up until 24 hours prior to the allotted time. Penkat Studio reserves the right to cancel a booking if the Client is not punctual and or they have not adhered to health and safety instructions and or if they are at fault for damaging Kit. The Client may be liable to Penkat Studio for the full cost of the session plus damages and loss of earnings.

Online Photograph Sales:
The Client is permitted to adhere to PhotoReflect and PayPal's policies where applicable. Please see Penkat Studio's Return/refund Policy.

Video sessions and video production with Penkat Studio:
Clients are permitted to cancel a booking up until 24 hours prior to the allotted time. Penkat Studio reserves the right to cancel a booking if the Client is not punctual and or they have not adhered to health and safety instructions and or if they are at fault for damaging Kit. The Client will be liable to Penkat Studio for the full cost of the session plus damages and loss of earnings which could be payable on the day.

Studio Hire (including video editing systems):
Clients are permitted to cancel a booking up until 24 hours prior to the allotted time.

Penkat Studio reserves the right to cancel a booking if the Client is not punctual and or they have not adhered to health and safety instructions and or if they are at fault for damaging Kit and or they have not left the studio in the same condition as they found it. The Client will be liable to Penkat Studio for the full cost of the session plus damages and loss of earnings which could be payable on the day.

Penkat Studio does need to be informed if any strange liquids and water are to be used in the studio. It can be used at our discretion.

Return/refund Policy:
Photography sessions with Penkat Studio:
Penkat Studio works on a no obligation promise that if you do not like the photographs then Penkat Studio will not charge you nor will you be given any photographs from the session. You simply walk away. Penkat Studio's copyright however will remain on the photographs from the session (see Prints, Copyright and Display for further details).

In the event of part or total photographic failure Penkat Studio’s liability will only extend to a part or total refund of all monies paid for photographic services. Penkat Studio will not be liable for any claims for consequential loses howsoever caused.

Online Photograph Sales and delivery of products produced outside of Penkat Studio or products produced in house that required extra post production time:
The Client is permitted to adhere to PhotoReflect and PayPal’s policies where applicable. If the Client is unhappy with a product, or the service provided, then the Client should contact Penkat Studio with the complaint as soon as possible. Penkat Studio will manage the complaint on an individual basis that will not affect the Client's statutory rights. Penkat Studio will determine and authorise refunds on this basis and any refund issued will be returned to the Client in a timely manner. The refund mechanism will be discussed and agreed between the Client and Penkat Studio but generally the refund will reach the Client via the mechanism the Client used initially.

In the event of part or total photographic failure Penkat Studio's liability will only extend to a part or total refund of all monies paid for photographic or video services. Penkat Studio will not be liable for any claims for consequential loses howsoever caused.

Video sessions and video production with Penkat Studio:
If the Client is unhappy with a product, or the service provided, then the Client should contact Penkat Studio with the complaint as soon as possible. Penkat Studio will manage the complaint on an individual basis that will not affect the Client's statutory rights. Penkat Studio will determine and authorise refunds on this basis and any refund issued will be returned to the Client in a timely manner. The refund mechanism will be discussed and agreed between the Client and Penkat Studio but generally the refund will reach the Client via the mechanism the Client used initially.

Penkat Studio's copyright however will remain on the footage (rushes) from the session (see Prints, Copyright and Display for further details).

In the event of part or total photographic failure Penkat Studio's liability will only extend to a part or total refund of all monies paid for video services. Penkat Studio will not be liable for any claims for consequential loses howsoever caused.

Studio Hire (including video editing systems):
If the Client is unhappy with the service provided or is unable to use space or kit that was booked because it failed due to fault by Penkat Studio then the Client should contact Penkat Studio with the complaint as soon as possible. Penkat Studio will manage the complaint on an individual basis that will not affect the Client's statutory rights. Penkat Studio will determine and authorise refunds on this basis and any refund issued will be returned to the Client in a timely manner. The refund mechanism will be discussed and agreed between the Client and Penkat Studio but generally the refund will reach the Client via the mechanism the Client used initially.

In the event of part or total photographic failure Penkat Studio's liability will only extend to a part or total refund of all monies paid for studio and editing systems hire services. Penkat Studio will not be liable for any claims for consequential loses howsoever caused.

Prints, Copyright and Display:
Owing to photographic and video processing techniques it may not be possible to match exactly all colours as seen by the human eye.

The photographs, digital negatives, prints, video, rushes, edits, post production and showreels produced by Penkat Studio are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without Penkat Studio's explicit written permission.

The Client hereby allows Penkat Studio to display any work produced by Penkat Studio for promotional use providing that the images used are used lawfully and without damage to the Client. Images placed in password protected galleries within the website are not available to the general public in the normal course of events. It is however impossible to prevent determined persons from accessing these galleries.

Privacy Policy:
Penkat Studio is committed to preserving your privacy. Any information that we hold is, subject to these terms, processed and kept securely in accordance with the Data Protection Act 1998. We employ security measures to protect any information that we hold about you from access by unauthorised persons, unlawful processing, accidental loss destruction and damage. We only keep the information for a reasonable period or as long as the law requires and we do not store any financial details about you.

We take reasonable steps to ensure that the information that we hold is accurate and up to date. You have a right to see any information held about you and to ask us to make any necessary changes. If you wish to do so, please contact us. By law we are entitled to charge a fee of £10 to meet our costs in providing you with details of the information we hold about you. Requests made on the Penkat Studio web site are logged (date, time, ip, username, port, mehod, uri-query, status, user-agent, referrer) however this information is only used for internal analysis and statistical use. Any data that may be given to external parties will not be directly attributable to your use, e.g. we may say we have 1000 subscribers in London, but we will not say which subscribers live in London.

The Website may contain links to Third Party Sites which are outside our control and are not covered by these Terms. You understand and agree that if you access such Third Parties using the links provided, the operators of those Third Party Sites may collect information from you which will be used by them in accordance with their own privacy policies. Your use of the Third Party Sites will therefore be governed by the privacy policies of those sites and not by this Privacy Policy. Penkat Studio shall not be responsible for the action of any Third Party Site Operators.
